We are starting or taking over a catering, trade or lodging business. Where should we begin?

We have heard that first we need to deal with the “MTR”. What is that?

MTR stands for “Minimum Technical Requirements”. These are the requirements you must fulfil in order to do business in certain areas such as catering, trade, lodging services etc.

Does this mean we can’t start with our business right after we have opened our company?

Yes, it does. Your business may begin once you have received a confirmation on fulfilment of all minimum technical requirements related to your planned business.

What should we do to receive the aforementioned confirmation?

After you have assured all the requirements related to your business have been fulfilled, you should submit a request to the government body in charge of issuing such confirmations.

In the Republic of Croatia, catering activities may be performed by natural and legal persons registered for performing catering activities, and who have fulfilled all the requirements related to this field.

What does it mean to register a business?

Registering a business implies listing the business into its related register (court register for legal persons, trade registers for natural persons or tradesmen, as well as other registers set by the law).

What is the meaning of “type of catering spaces” and why is it important?

There are several types of catering spaces, depending on the services provided inside, as well as the serving procedure. Most common ones include: cafes, bars, pubs, taverns, restaurants, pizzerias, fast food facilities etc.

This is important considering you can begin with your business once you have fulfilled all the minimum technical requirements which depend on the type of your catering space, as well as the general minimum requirements which must be fulfilled by all catering spaces.

Where can I submit a request on issuing an MTR fulfilment confirmation?

Depending on the location of your catering space, the request should be submitted to your local government body for your county or city (“City office in charge of economy and business”).

What should be enclosed to the request?

Along with the complete request (equal for all counties), you should enclose the following:

  • proof of paid administrative fee
  • copy of court register enrolment confirmation (for legal persons) or trade register enrolment confirmation (for natural persons)
  • proof of the right to use the space in order to perform business activities (proprietary document or lease contract)
  • proof that your business space fulfilled special regulation requirements

    1. operational licence issued in accordance with Construction Act or documents which are considered an operational licence (according to former Acts)
    2. licence to perform business services, if the building in which they are to be performed is considered a cultural heritage (issued by conservational division of the Ministry of Culture or City Institute for Protection of Monuments, Culture and Nature for Zagreb City area)
  • report on electrical installation testing (attestation)
  • report on gas installation leak-proofing – if any
  • report on gas-consuming appliances – if any
  • report on ventilation effectiveness
  • report on noise testing, i.e., a solution issued by the Ministry of Health that all noise protection requirements are fulfilled inside the workspace
  • report on drinking water’s health requirements (if the catering business is newly opened or hasn’t been in business for the last six months)
  • report on air pollution caused by harmful emissions (for catering spaces which prepare and serve meals)
  • proof of water and plumbing installation tightness (if the catering business is newly opened)
  • proof of septic tank tightness (for spaces located in areas that aren’t connected to public sewerage systems).

Is it necessary to procure a new confirmation on minimum requirements fulfilment if we are taking over an existing business?

If the catering service in question is the same as before, new confirmation isn’t necessary. In this case you must hand in a request on continuation of catering services with the following enclosed:

  • copy of court register enrolment confirmation (for legal persons) or trade register enrolment confirmation (for natural persons)
  • proof on the right to use the space in order to perform business activities (proprietary document or lease contract)
  • statement (in accordance with the law) in which the business in question confirms that there haven’t been any significant changes compared to the previous minimum requirements fulfilment
  • proof of paid administrative fee.

Minimum requirements for performing trade business and trade services

If you are planning to act as a natural or legal person/tradesman, you may only deal in trade if you are registered in its related business, and if all the minimum technical requirements for trade services have been fulfilled. They will depend on the planned business form and manner.

What does it mean to register a business?

Registering a business implies enrolling your business into its matching register (court register for legal persons or trade registers for natural persons).

If you plan to deal with online trading, you will have to register your business under “Informational society services”.

Which regulation deals with technical and other requirements for trade spaces?

Requirements such as trade space appearance and equipment, additional rooms, outdoor spaces and other, are determined by Minimum Technical Requirements Act, which also holds other requirements related to trade spaces, trading equipment and tools in trade spaces, as well as requirements for selling products outside shops.

When and where should we submit a request for minimum requirements fulfilment confirmation?

This request is usually submitted after you have fulfilled all the mandatory requirements for your business. Depending on the location of your trade space, the request should be submitted to your local government body for your county or city (“City office in charge of economy and business”).

What should be enclosed to the request?

Along with the complete request (equal for all counties), you should enclose the following:

  • proof of paid administrative fee
  • copy of court register enrolment confirmation (for legal persons) or trade register enrolment confirmation (for natural persons)

Is it possible to continue doing business inside the same trade space without issuing a new requirement fulfilment confirmation?

If the confirmation on requirement fulfilment existed before, the business inside the trade space can be continued without a new confirmation. This possibility isn’t affected by the eventual change in the type of merchandise being sold, if all the requirements listed in the Act are fulfilled.

What does household lodging space imply?

It implies a functional whole in which the host offers lodging services. Considering the different types of services that can be provided, we can differentiate several types of lodging spaces: rooms, apartments, studio apartments, holiday homes, camps etc.)

When should I submit a request for offering household lodging services

The request should be submitted when the lodging space is ready to receive guests. Before that, as a host you should fulfil all the requirements related to the type and category of your lodging space, in coordination with your lodging capacity.

In Republic of Croatia, every natural and legal person registered for catering services can start a catering related business, if they fulfil the set requirements.

Registering a business implies enrolling your business into its matching register (court register for legal persons or trade registers for private persons / tradesmen, and other registers determined by the law).

What does the term “type of lodging space” imply and why is it important?

Related to catering services provided inside, we can differentiate several lodging facilities such as: hotels, camps, holiday homes, apartments, studio apartments, rooms etc.

This is important considering you can only start offering lodging services after you have fulfilled all the mandatory requirements, which depend on the type of lodging service and are in accordance with lodging capacity.

When and where should I submit a request on minimum requirements fulfilment confirmation?

This request should be submitted after you have fulfilled all the mandatory requirements depending on the type and category of your lodging space.

Depending on the location of your lodging-catering space, the request should be submitted to your local government body for your county or city (“City office in charge of economy and business”).

The exceptions are lodging spaces from the “Hotels” category which are marked by the number of stars, as well as “Camp” and “Marina” categories. These are submitted to the Ministry of Tourism and Sports.
